Welcome to Virginia Lending Hub. These Terms of Service ("Terms") govern your use of virginialendinghub.com (the "Site"), operated by Matthew Nelligan, LLC ("we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. ABOUT OUR SERVICE

Virginia Lending Hub is a lead generation service that connects consumers seeking mortgage information with licensed mortgage lenders and brokers in Virginia.

WE ARE NOT A LENDER. We do not make loans, offer loan commitments, or make credit decisions. We do not charge consumers any fees for using our service. We receive compensation from lenders when we connect them with potential borrowers.

Any mortgage loan terms, rates, or offers you receive come from third-party lenders, not from us. We do not guarantee that you will receive any particular rate, terms, or loan approval.

2. ELIGIBILITY

You must be at least 18 years old and a legal resident of the United States to use the Site. By submitting information through our forms, you represent that:

  • You are at least 18 years old
  • The information you provide is accurate and complete
  • You are inquiring about mortgage products for yourself or a property you are authorized to finance
  • You consent to being contacted by mortgage lenders via phone, email, and text message

3. HOW THE SERVICE WORKS

When you submit a form on our Site:

  • Your information is shared with one to three licensed mortgage lenders or brokers
  • These lenders will contact you directly, typically within 24 hours
  • You are under no obligation to work with any lender who contacts you
  • Any loan application and approval process occurs directly between you and the lender

4. NO GUARANTEE OF RESULTS

We do not guarantee that:

  • You will qualify for any mortgage product
  • You will receive any particular interest rate or terms
  • Any lender will contact you
  • Any information on our Site is current or error-free

Mortgage rates, programs, and requirements change frequently. Information on our Site is for educational purposes only and may not reflect current market conditions. Always verify information with a licensed mortgage professional.

5. ACCURACY OF INFORMATION

While we strive to provide accurate and helpful information, we make no warranties about the completeness, reliability, or accuracy of any information on the Site.

Market data, home prices, interest rates, and other figures are based on available sources and may not be current. Calculations and examples are for illustrative purposes only and may not reflect your actual situation.

6. USER CONDUCT

You agree not to:

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MATTHEW NELLIGAN, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • YOUR USE OF OR INABILITY TO USE THE SITE
  • ANY INFORMATION PROVIDED ON THE SITE
  • ANY ACTIONS TAKEN BY LENDERS OR OTHER THIRD PARTIES
  • UNAUTHORIZED ACCESS TO YOUR INFORMATION
  • ANY OTHER MATTER RELATED TO THE SITE

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Matthew Nelligan, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any information you provide through the Site

12. DISPUTE RESOLUTION AND ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Agreement to Arbitrate

You and Matthew Nelligan, LLC agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of the Site shall be resolved through binding individual arbitration rather than in court, except that either party may bring individual claims in small claims court if they qualify.

Waiver of Class Actions

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

If this waiver of class claims is found unenforceable, then the entirety of this arbitration provision shall be null and void.

Arbitration Procedures

Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Richmond, Virginia, unless you and we agree otherwise or the arbitrator determines that such venue would be unreasonably burdensome.

The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Opt-Out

You may opt out of this arbitration provision by sending written notice to matthew@elevateprosites.com within 30 days of first using the Site. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

14. CHANGES TO TERMS

We may modify these Terms at any time by posting the revised version on the Site. The "Last Updated" date indicates when the Terms were last changed.

Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the changes, stop using the Site.

15. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Matthew Nelligan, LLC regarding your use of the Site.
